In the majority of cases, compensation for discrimination will include an injury to feelings award. These awards are calculated in accordance with the Vento Bands, derived from the leading case of Vento v Chief Constable of West Yorkshire Police (No 2) [2003] IRLR 102, which sets out clear guidelines for the amount of compensation to be given for injured feelings in discrimination cases.
The following updates to the Vento Bands have been published by the Presidents of the Employment Tribunals in England and Wales, which have been adjusted to take account of the Retail Prices Index (RPI) measure of inflation:
- A lower band of £1,100 to £11,200 for less serious cases.
- A middle band of £11,200 to £33,700 for cases which do not merit an award in the upper band.
- An upper band of £33,700 to £56,200 for the most serious cases.
- Amounts in excess of £56,200 can be awarded in very exceptional cases.
The new bands will apply to claims presented on or after 6 April 2023.
